DOB Improperly Delivered Violation Notice

DOB issued a violation notice to landlord for installing a gas shut-off valve without a plumbing permit. Landlord claimed that the violation notice was improperly delivered. The ALJ ruled against landlord and fined it $400. Landlord appealed and won. DOB served the violation notice on a restaurant owner at the building. But she wasn't an officer, director, managing or general agent, or cashier of the corporate landlord entity. ECB dismissed the violation and revoked the fine.
