DOB Approval for Gas Installation Not Submitted on Time

Landlord applied for MCI rent hikes based on the installation of a gas chiller/hot-water heater unit. The DRA denied landlord's application because landlord didn't submit DOB's approval for this equipment. Landlord appealed, requesting additional time to submit the approval. With its appeal, landlord attached a copy of what it claimed to be the required approval. The DHCR ruled against landlord. The DRA had already granted landlord more than 20 months of extra time to submit the approval. Also, the document landlord submitted with its appeal was difficult to read and didn't contain a certification from DOB or any indication that DOB had generated an original document.
