Landlord sued to evict tenant for creating a nuisance. Landlord claimed that tenant's long history of improper behavior and unsanitary apartment conditions created a fire and safety hazard in the building. Landlord and tenant signed a settlement agreement in court by which tenant agreed to keep her apartment and common areas clean. Landlord later went back to court, claiming that tenant breached the agreement by leaving garbage and debris throughout the common areas. Tenant claimed that she only left items out to be picked up.
