DHCR Will Consider Rent of Comparable Apartments

Tenant complained that the first rent-stabilized rent for his apartment was in excess of the fair market rent. The DRA ruled against tenant. Tenant appealed, claiming that the comparable rents submitted by landlord weren't acceptable. The DHCR ruled against tenant. The comparable rents in question were initially registered with the DHCR during the same rent guidelines periods as tenant's apartment, were the same size as tenant's apartment, and weren't challenged.
