DHCR Sets Fee for Ancillary Community Room Use

Tenants complained that landlord charged excessive fees for use of the building's community room. The former Mitchell-Lama building had become rent stabilized in 1990. In a prior DHCR proceeding, it was established that the community room was an ancillary service subject to rent stabilization. The DHCR now set the fee for tenants to rent the community room by taking the last fee charged under Mitchell-Lama and adding annual rent guidelines increases to bring the fee up to a present rate. This brought the 1990 fee of $75 up to $159.88 in 2013.

And landlord couldn't charge the tenant association for use of the community room for tenant meetings. The charge applied only to private use by tenants. Landlord could charge a market rate to nontenants for use of the room.
