DHCR Relied on HPD Hot Water Violations to Reduce Rent

Rent-stabilized tenant complained he had no hot water. The DRA ruled for tenant based on HPD hot water violations and reduced tenant’s rent due to a reduction in services. Landlord appealed and lost. Landlord claimed that hot water had been restored since Aug. 2, 2014, that tenant turned the hot water supply off to his apartment, and then refused access for repair. But HPD had issued two hot water violations, dated July 22, 2014, and Sept. 5, 2014. Landlord also failed to prove it had requested access from tenant.
