DHCR Relied on Building-Wide HPD Heat Violation

Tenant complained of a reduction in services based on lack of heat. The DRA ruled for tenant and reduced his rent. Landlord appealed and lost. Landlord argued that the DRA relied incorrectly on an HPD violation issued to landlord because that violation referred to a different apartment. But the HPD violation was issued with a “664” order number. This indicates that the violation was building-wide based on inspection of either the boiler or multiple apartments.
