DHCR Properly Relied on HPD Records to Decide Hot Water Complaint

Rent-stabilized tenant complained of insufficient hot water in her apartment. The DRA ruled for tenant and reduced her rent. Landlord appealed and lost. Landlord complained that the DRA relied solely on an HPD website listing of a heat violation but that it had filed a certificate of correction with HPD on July 25, 2014. This was before the DRA order was issued. But HPD’s website listed “cert invalid.” Landlord claimed that this was an error. But the DRA properly relied on HPD records to rule on the hot water complaint.
