DHCR Previously Ruled Tenant Was Rent Stabilized

Tenant complained of a rent overcharge. She claimed that her apartment had been rent controlled since 1968 and that she had pass-on rights. She said that landlord made her sign a lease in 1995. The DRA ruled against tenant, and she appealed. The DHCR ruled for tenant in part. In a prior case, the DHCR ruled that tenant was rent stabilized. Her overcharge complaint would therefore be processed under rent stabilization, not rent control.
