DHCR Inspector Found Rust Stains and Leaks in Garage

Rent-stabilized tenant complained of a reduction in building-wide services based on garage conditions. The DRA ruled for tenant and reduced his rent based on rust stains and leaks found in various parts of the garage. Landlord later applied for rent restoration based on the restoration of services. The DRA ruled against landlord, who appealed and lost. Landlord claimed that the conditions were minor. But DHCR inspection showed that the walls and ceilings of one part of the garage had rust stains in various areas due to water damage.

But DHCR inspection showed that the walls and ceilings of one part of the garage had rust stains in various areas due to water damage. In another area of the garage, there were areas of water damage and water leaking from the ceiling. The inspector also noted rust and damp areas to the structural beams in some areas of the garage. The DRA properly determined that the landlord had failed to restore the conditions for which the rent reduction was ordered.
