DHCR Inspected the Wrong Walls

Rent-stabilized tenant complained of a reduction in services based on a defective kitchen wall. The DRA ruled for tenant after inspection and reduced her rent. Landlord appealed and won. Landlord pointed out that tenant complained specifically that the kitchen wall near the window was defective. Landlord had repaired that wall before the DHCR sent an inspector in February 2013.

Landlord pointed out that tenant complained specifically that the kitchen wall near the window was defective. Landlord had repaired that wall before the DHCR sent an inspector in February 2013. The inspector noted defects in two kitchen walls but didn’t report any defects to the wall near the window. The rent reduction was revoked.
