DHCR Inspected Wrong Elevator

Tenant complained of a reduction in building-wide services based on a defective elevator. The DRA ruled for tenant after inspection and reduced her rent. Landlord appealed and won. Landlord claimed that the DHCR inspected the wrong elevator. Landlord admitted that there was ongoing elevator modernization work being performed at the time of inspection. But the elevator servicing tenant's wing of the building was completed on Feb. 19, 2010, about a month before the DHCR's inspection. Tenant acknowledged that the west wing elevator was repaired by Feb.
