DHCR Grants Rent Reduction for Inadequate Heat

Rent-stabilized tenant complained that her apartment didn't receive adequate heat. The DRA ruled for tenant and reduced her rent. Landlord appealed and lost. HPD records showed that there was an outstanding violation for inadequate heat service at the apartment. Landlord claimed that the violation was corrected on the day that the DRA issued its order. But HPD issued its violation notice on Oct. 17, 2018, and landlord claimed that the condition was repaired on Oct. 29, 2018. The DRA properly relied on the data provided by HPD.
