DHCR Determined Rent Overcharge Claim Based on Submitted Rent Ledgers

Tenants complained to the DHCR of rent overcharge. In response, landlord submitted a rent ledger covering rent payment periods through July 2016. The DRA then asked tenants for an updated statement of rent payments, but tenants didn't respond. The DRA found some overcharge and ordered landlord to refund $171, including triple damages. Tenants appealed and lost. They claimed that there were additional overcharges through April 2017 and submitted a rent ledger in support of their claim.

But the DHCR wouldn't consider tenant's additional documentation for the first time with tenant's PAR. The DRA's rent calculations were otherwise correct.
