DHCR Approves Replacement of Metal Keys with Key Fob System

Landlord asked the DHCR for permission to modify building services by replacing the building's traditional metal key entry system with an electronic key fob entrance system. The DRA ruled for landlord, based on a number of conditions. Tenants appealed and lost. Tenants complained that landlord approved the key fob system without prior DHCR approval, that it often failed, and that HPD had issued multiple violations based on the faulty system.

Landlord asked the DHCR for permission to modify building services by replacing the building's traditional metal key entry system with an electronic key fob entrance system. The DRA ruled for landlord, based on a number of conditions. Tenants appealed and lost. Tenants complained that landlord approved the key fob system without prior DHCR approval, that it often failed, and that HPD had issued multiple violations based on the faulty system. But new landlord explained that when it bought the building there was an ongoing problem of theft of packages delivered for tenants, and the front door lock was broken and repaired repeatedly. Landlord changed the lock system before knowing that this was a modification of required services. Landlord held off deactivating the existing mechanical lock system until the DHCR approved its service modification application. The DHCR didn't find sufficient problems with the key fob system that would warrant denial of landlord's application to modify services. If problems persisted, tenants could file service reduction complaints with the DHCR.
