Denial of Restoration Affects Only One Tenant

LVT Number: 14245

Tenants complained of a reduction in building-wide services based on landlord's discontinuance of providing storage space. The DRA ruled for tenants. Landlord later restored storage space and applied for rent restoration. The DRA ruled for landlord. One tenant appealed, claiming that the space was unsafe because there was a large hole in the room. The DHCR ruled for tenant and revoked the rent restorations for all tenants. Landlord appealed. The court sent the case back to the DHCR for reconsideration. The DHCR ruled for landlord in part.

Although the conditions in the storage room warranted revocation of the rent restoration, only one tenant had appealed the order restoring rents. So revocation of the rent restoration could apply only to this tenant.
