Defective Windows Irrelevant

The DRA reduced tenant's rent based on a reduction in services. Landlord applied to restore the rent, claiming that repairs had been made. The DRA denied landlord's application, in part because an inspection showed that two sliding windows in tenant's apartment were defective. Landlord appealed. The DHCR noted that the DRA's original order stated that window screens, and not the windows themselves, were defective. It was an error to reject landlord's application to restore rent based on a condition that wasn't part of the original rent reduction order
