Defective Air Conditioner

Tenant complained of a reduction in services based on a number of conditions. The DRA ruled for tenant and reduced his rent. Among other things, the DRA found that a bedroom air conditioner was defective. Landlord appealed. Landlord claimed that it was inappropriate to inspect tenant's air conditioner on Sept. 20, when air conditioning wasn't needed. The DHCR ruled against landlord. The inspection date was still within the summer season. And the inspector ran the air conditioner for an extended period of time and measured a temperature at the coil of 60 degrees Fahrenheit.
