Date of Occurrence Incorrect

LVT Number: 9343

The DOB issued landlord a violation notice, stating that the violation had occurred on July 1, 1988, which was four years before it sent landlord the violation notice. The DOB conceded that the date listed was probably incorrect, and the ALJ dismissed the violation. The DOB appealed, and the ECB ruled for landlord. The violation notice was defective because the issuing officer had put the wrong date on the violation notice.
