Damp Cabinet Under Sink

LVT Number: 9089

Tenant complained of reduced services, claiming that the cabinet under the kitchen sink was damp. A DHCR inspector found the cabinet damp but not rotted, and the DRA reduced the rent. Landlord appealed, arguing that the rent reduction wasn't justified because tenant didn't specify the cause of the dampness. The DHCR agreed with landlord. To get a rent reduction, tenant must establish the cause of the moisture problem---for example, defective plumbing.
