Damage from Water Leaks

Tenant sued landlord for damage caused by water leaking into his apartment. The trial court ruled for tenant, and landlord appealed. Landlord claimed that the leak was caused by openings in the coping stones of the parapet wall and openings in the masonry wall. Landlord blamed the contractor and architect who'd renovated and repaired the brick work several years earlier. The appeals court ruled against landlord. Landlord was responsible for keeping the building in good repair.
