Criminal Harassment Charge Against Tenant Dismissed

LVT Number: 8432

(Decision submitted by Woodmere attorney Ira J. Raab, attorney for the tenant.) Tenant assaulted landlord, who immediately filed criminal charges against tenant. But, the next day, landlord and tenant signed a stipulation in civil court by which tenant agreed to move out by July 31. In return, landlord agreed to drop all criminal charges. Tenant moved out one day late, on Aug. 1, because July 31 fell on a Saturday and tenant was an Orthodox Jew who observed the Sabbath. The court dropped the criminal charges. Tenant had complied with the stipulation.

Landlord and tenant had an ongoing personal dispute, which didn't affect the community; tenant had no criminal record, and landlord had achieved her goal of removing tenant from the building through the agreed-upon stipulation.
