Landlord appealed, claiming that the stonewall replacement, together with replacement of all the exterior pedestrian surfaces, qualified as an MCI. The DHCR ruled for landlord. The steps had exceeded their useful life, and the retaining walls were replaced because they were seriously decaying and could have collapsed.
