Landlord applied for MCI rent hikes based on a number of improvements. The DRA granted rent hikes for the installation of rat slabs, and tenants appealed. They claimed this wasn't an MCI. The DHCR ruled against tenants. The rat slabs consisted of two inches of concrete poured over plastic sheeting that was laid out over the dirt floor of each crawl space under each of the seven buildings in the complex. Landlord claimed this installation would deter rodent and insect infestation in the buildings, and reduce the buildup of moisture under the buildings.
