Landlord applied for MCI rent hikes based on boiler/burner replacement and asbestos removal. The DRA ruled for landlord. Tenant appealed, claiming that the asbestos was removed from outside the boiler room and wasn't related to the boiler/burner MCI installation. The DHCR ruled against tenant. Landlord's contractor specified that the boiler/burner installation couldn't be done until the boiler room was made asbestos-free. Landlord submitted a separate contract for this work and canceled checks. Landlord proved the asbestos removal was done in connection with the boiler/burner replacement.
