Conversion of Self-Parking Garage to Valet Parking

Landlord applied to the DHCR for permission to convert a self-parking garage system to valet parking. The DRA ruled against landlord. Landlord appealed, claiming that because of the layout of the garage, some tenants must rent double spaces, even though they have only one car, and that the modification would correct this. The owner also argued that valet parking would allow landlord to use the garage passageway to provide additional parking spaces for tenants, and that valet parking would provide increased security in the garage. The DHCR ruled against landlord. Landlord admitted that the plan to create more parking spaces was intended to extend use of the garage to the public. This would significantly affect service provided to tenants, who objected to the proposal. The building was located near the George Washington Bridge, so tenants had valid concerns about traffic congestion and security.
