Landlord applied for MCI rent hikes based on the installation of a concrete yard and basement concrete slab work. The DRA ruled against landlord, finding that the work was done in a piecemeal manner and that the basement concrete slab work didn't qualify as an MCI. Landlord appealed and won. The DHCR has previously ruled that removal and replacement of the entire concrete floor of a basement is structural in nature and qualifies as an MCI. And the work was done over eight months by one contractor, with no complaints by tenants. So the work wasn't piecemeal.
