Complaints Properly Consolidated

Tenants complained of a reduction in services. The DHCR ruled for tenants and reduced their rents. Landlord appealed, claiming that the DHCR improperly consolidated two complaints. The court ruled for landlord, and the DHCR appealed. The appeals court ruled for the DHCR and reinstated the DHCR's ruling. Landlord never raised the issue before the DHCR that he wasn't notified of the consolidation of the two complaints. So it shouldn't have been considered for the first time in the court's review of the DHCR decision.
