Complaint Described Water Leak Incorrectly

Rent-stabilized tenants complained to the DHCR of a reduction in building-wide services based on various conditions. The DRA ruled for tenants based on inspection, which confirmed that janitorial service in the public areas, common area floor tiles, common hallway landings, and the roof door latch weren't maintained. The DRA also found a fifth-floor water leak.

Rent-stabilized tenants complained to the DHCR of a reduction in building-wide services based on various conditions. The DRA ruled for tenants based on inspection, which confirmed that janitorial service in the public areas, common area floor tiles, common hallway landings, and the roof door latch weren't maintained. The DRA also found a fifth-floor water leak.

Landlord appealed and won, in part. Landlord claimed that the cited conditions were de minimis, or minor. The DHCR found that no conditions were de minimis. But tenants had complained of a leak in the hallway near Apt. 2A. The inspectors, indicating that leaks were found on the fifth-floor hallway ceiling, specified that there was no water damage near Apt. 2A. So the fifth-floor water leak must be excluded from the list of items found not maintained.
