Community Room Is Required Service

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants and ordered landlord to restore a community room. Landlord appealed, claiming that a community room was never provided. The DHCR ruled against landlord. Landlord admitted that, in the past, the room was used for tenant meetings. The Certificate of Occupancy and building plan also referred to the room as the Recreation Room. And there was no grounds to limit tenants' use of the room to tenant meetings.
