Cleaning Once a Day Isn't Enough

The DOS issued a violation notice to landlord for a dirty sidewalk. The notice stated that papers, cans, and magazines were scattered all over the sidewalk in front of the building. Landlord claimed that his super sweeps the sidewalk each morning, and that there's a lot of pedestrian traffic in the neighborhood. The ALJ fined landlord $50, and landlord appealed. The ECB denied landlord's appeal. Considering the building's location in midtown Manhattan, cleaning once each day isn't enough.
