Cleaning Every Other Day Not Enough

DOS issued a violation notice to landlord for not cleaning 18 inches into the street. The inspector saw accumulated bottles, papers, and other litter matted in the gutter in front of landlord's building. Landlord claimed that she swept and hosed the area every other day. She said it was hard to clean the area because of parked cars. The ALJ ruled against landlord and fined her $50. Landlord appealed and lost. Cleaning every other day is not enough. Landlord must make reasonable efforts to keep the area clean. The matted litter showed that landlord didn't do so.
