Clauses to Include in Vacancy Lease for Loft Unit

Loft tenant who had been found subject to rent stabilization by the Loft Board asked the DHCR questions about required lease provisions. In an opinion letter, the DHCR noted that a landlord doesn't have to include any of the old commercial lease clauses in tenant's new rent-stabilized lease. Landlord must simply offer a vacancy lease consistent with the rent stabilization law. If tenant refuses to sign a proper rent-stabilized vacancy lease, landlord may have reasons to sue for eviction.
