Chronic Nonpayment of Rent

Facts: Landlord sued to evict tenant for chronic nonpayment of rent after starting six nonpayment cases. Tenant claimed that DSS was responsible for her chronic nonpayment because DSS didn't make timely Jiggetts payments on tenant's behalf. Court: Landlord wins. Since 1998, tenant didn't pay her share of rent, whether or not DSS was paying a portion of it. Tenant admitted that DSS wasn't paying her full rent because she hadn't made her own payments. Tenant couldn't blame DSS for her continual failure to pay rent each month on time.
