Certificate of Correction of Standpipe Violation Not on File

The Fire Department issued a violation notice to landlord for failing to maintain pressure in the building's standpipe and failing to conduct a pressure test of the standpipe/siamese connection. The violation notice told landlord to cure the condition by May 26, 2010. Landlord claimed that he mailed the certificate of correction on May 24, but the Fire Department said it wasn't received. The ALJ ruled for landlord and dismissed the violation without penalty. The Fire Department appealed and won.

The ALJ erred in imposing zero penalties since the Fire Department's records contained no record of filing landlord's certificate of correction on or before the required cure date. On the hearing date before the ALJ, the Fire Department found no certificate on file. So landlord was fined $650.
