Certificate of Approval Not Posted

The Fire Department issued a notice to landlord for not having a boiler certificate of approval. The ALJ fined landlord $400, finding that the certificate of approval was never posted or provided. Landlord appealed, claiming that the ALJ never asked him if the certificate was posted. Landlord claimed the certificate was posted on a boiler room wall. The ECB ruled against landlord. Even if the ALJ didn't ask, landlord never offered any proof on the issue either. And there was no way to tell if the certificate landlord claimed was posted was, in fact, posted on the inspection date.
