Cardbox Box Improperly Used as Trash Receptacle

DOS issued a violation notice to landlord for using an improper receptacle for trash. The DOS inspector had found household waste placed inside a cardboard box placed out for collection. Landlord claimed that he had placed only flattened and tied cardboard boxes out for collection the night before. Landlord claimed that a neighbor's trash might have blown onto his boxes during a windy night before collection. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. Landlord's testimony was insufficient to overcome the observations stated on the violation notice.
