Building-Wide Rent Cut for Missing Tiles on Fourth Floor

LVT Number: 12625

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants and landlord appealed, claiming that any rent cut for damaged floor tiles on the building's fourth floor should be limited to the fourth-floor apartments. The DHCR ruled against landlord. Since the condition was in the building's common area and all tenants could occupy those areas, the rent reduction was properly granted to all complaining tenants.
