Building Renovation Reduced Tenant's Living Space

Tenant complained of a reduction in services. He said that landlord reduced the size of a room in his apartment as a result of building renovations. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that the DRA's finding was vague. Landlord also claimed that there was no reduction in living space and that any change in the dimensions of the apartment was minor. The DHCR ruled against landlord. Landlord had admitted that there was a change in the dimensions of tenant's living space.

Tenant showed that his living room furniture no longer fit in the area where it had been located. This wasn't a minor condition.
