Building Previously Owned by Nonprofit Institution

Tenant complained of a rent overcharge. The DRA ruled against tenant and dismissed the complaint. Tenant had lived in the apartment since 1976. The DRA found that the apartment was exempt from rent stabilization during ownership of prior landlord, a not-for-profit institution. Tenant appealed and lost. The apartment was rent controlled until sometime before June 1, 1976. Upon decontrol, the apartment was exempt from rent stabilization because it was owned at the time by a charitable institution.

The apartment became stabilized for the first time in March 1983, when the building was sold to a private landlord. Landlord charged tenant the same rent charged by prior landlord and then offered proper renewal leases in accordance with rent guidelines. There was no overcharge.
