Building May Not Need Registration Statement

LVT Number: 19029

Landlord sued to evict tenant for nonpayment of rent. The court dismissed the case on its own because landlord had presented no multiple dwelling registration (MDR). Landlord appealed, claiming that it wasn't given the chance to show that the building may not need a MDR. The building was registered as an IMD in the 1980s. But landlord stated that tenant's loft was the only residential unit in the building. And a statement in a Loft Board ruling from 2000 concerning registration requirements wasn't binding and didn't directly address the issue.
