Building Located Near School

The DOS issued a violation notice to landlord for not cleaning 18 inches into the street. The notice stated that there was considerable litter in the curb at 3 p.m. Landlord noted that the 45-unit building was located near a school. Landlord claimed that the superintendent swept four times each day between 6:30 a.m. and noon and again between 3:00 and 3:30 p.m. The ALJ ruled against landlord, and fined him $50. Landlord appealed, and the ECB agreed with the ALJ that given the large amount of litter found in front of the building, landlord's claims of regular cleaning were questionable. Landlord gave no other explanation or proof; his appeal was dismissed.
