Building Located Near School

The DOS issued a violation notice to landlord for not cleaning 18 inches into the street. The notice stated that there was considerable litter in the curb at 3 p.m. Landlord noted that the 45-unit building was located near a school. Landlord claimed that the superintendent swept four times each day between 6:30 a.m. and noon and again between 3:00 and 3:30 p.m. The ALJ ruled against landlord, and fined him $50. Landlord appealed, and the ECB agreed with the ALJ that given the large amount of litter found in front of the building, landlord's claims of regular cleaning were questionable.
