Building Exempt from Fire Exit Sign Requirement

The Fire Department issued a violation notice to landlord for failing to provide exit signs in the hallway for each stairwell on all floors of its apartment building. Landlord argued that because the building was in a J2 Occupancy Group it was exempt from the exit sign requirement under the 1968 Building Code. The ALJ ruled against landlord and fined it $600. Landlord appealed and won. Building Code Section 27-383(a) did exempt occupancy groups J2 from the requirement to post exit signs.

And since landlord's building was primarily residential, it qualified as J2 occupancy, even though there was a commercial use in the cellar. ECB reversed the ALJ's decision and dismissed the violation.
