Building Construction Conditions Were Minor

Rent-stabilized tenant complained of a reduction in building-wide services based on construction conditions at the building. While landlord was doing construction in the building, tenant claimed that there was constant loud noise, dust, and debris for two years. The DRA ruled against tenant, finding no basis for a rent reduction. Tenant appealed and lost. The DHCR's inspector observed ongoing construction throughout the building, but found no excessive noise, and minimal dust, dirt, and debris. Any construction conditions were minor and didn't result in any decrease in services.
