Broken Sidewalk Shed Lights

DOB issued a violation notice to landlord for not providing lights in a sidewalk shed surrounding the building. Landlord claimed that it provided the lights, but that they were continually vandalized by homeless people using the shed as a shelter. The ALJ ruled for landlord and dismissed the violation. DOB appealed, pointing out that city regulations state that sidewalk shed lighting must be inspected nightly and that any burned-out or missing lightbulbs must be replaced immediately. ECB ruled for DOB.
