Broken Cornice Is Hazardous Condition

DOB issued a violation notice to landlord based on a broken cornice at the front of a building roof. Landlord claimed that the two holes in the decorative sheeting of the cornice didn't create an unsafe condition. The ALJ ruled against landlord and fined it $800. Landlord appealed and lost. Although landlord and its witness had testified that they believed there was no danger of the cornice falling, they both admitted that the cornice was corroded and rusty, and had holes. So the finding that the condition was hazardous was justified.
