Boiler Room Painting Unrelated to MCI

Landlord applied for MCI rent hikes based on the installation of a boiler/burner. The DRA ruled for landlord. Tenant appealed and won, in part. Tenant claimed that some of work included in the cost of the MCI didn't qualify. The DHCR agreed. Boiler room painting and installation of a new fluorescent light fixture in the boiler room were not necessary or directly related to the boiler/burner installation even though the work was performed at the same time. The DHCR removed the $650 cost of these items from the total approved MCI cost.
