Boiler Room Key Sign Not Required

DEP issued a violation notice to landlord for not giving access to a DEP representative to the boiler room by not posting a sign stating the location of the key to the boiler room. Landlord argued that since the boiler room had never been locked, the requirement to post a sign didn't apply. The ALJ ruled against landlord and fined it $220. Landlord appealed. ECB ruled for landlord and revoked the fine. Since there was no boiler room key, no sign was needed.
