Bathroom Tiling Improperly Installed

Tenant complained of a reduction in services based on a bathroom tiling condition. The DRA ruled for tenant and reduced his rent. Landlord later applied for rent restoration based on repair of the condition. The DRA ruled against landlord based on an inspection that found that the bathroom tiling had been repaired in an unworkmanlike manner. Landlord appealed, claiming that there was a curve in the wall where a pipe was and that the work was done as well as possible under the circumstances. The DHCR ruled against landlord.

An inspection showed that although bathroom tiles had been repaired, the new tiles weren't properly installed. There were areas that were uneven and bulging. Landlord could have resurfaced or rebuilt the wall to allow for proper tiling.
