Tenant didn't have a balcony and claimed that he shouldn't have to pay for this improvement. The DHCR ruled against tenant. The DHCR and the courts have ruled previously that all tenants benefit directly or indirectly from a balcony installation, and so all tenants must pay the MCI rent hike.
